Boraca Terms and Conditions

Welcome to Boraca, a premier furniture shop located in Marlow, Buckinghamshire. By purchasing our products, you agree to the following terms and conditions. These terms are governed by the laws of the United Kingdom and are designed to ensure clarity and mutual understanding.

1. Payment

Full and final payment for products from Boraca is required before delivery of goods. Payment must be made through the accepted methods provided at the time of purchase. By completing a purchase, you confirm that you are authorised to use the payment method and that the payment information provided is accurate.

2. Delivery of Goods

All lead times provided are approximate and subject to change. We strive to meet the estimated delivery dates; however, Boraca cannot be held responsible for delays caused by acts of God, shortage of materials, or other circumstances beyond our control. In the event of such delays, we will notify you as soon as possible and work towards a prompt resolution.

3. Warranties

All goods are sold 'as is' at the time of purchase. The buyer has been given the opportunity to inspect the goods or to have them inspected and has accepted the goods in their current state. Boraca makes no warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose, except as provided by law.

4. Natural Products

Each item from Boraca is unique and may be made from natural materials. For example, wooden products may have unique markings, grain patterns, and knots. These characteristics are inherent to natural materials and do not constitute product faults. Some movement within wooden products may also occur which is also normal with fluctuating temperatures within rooms. Maintenance on some products will therefore be required. By purchasing these items, you acknowledge and accept these natural variations.

5. Returns

5.1 Made-to-Order or Bespoke Items Any made-to-order or bespoke items, such as a dining table, cannot be cancelled once the order has been agreed upon and signed for. These items are crafted specifically for you and are not eligible for cancellation or return.

5.2 Other Items For other items, returns are acceptable within 14 days of receipt, provided the goods are in their original condition. Upon receipt and inspection of the returned goods, a credit note will be issued for the purchase amount. Refunds will not be provided. This policy does not affect your statutory rights, including your right to return defective goods as per the Consumer Rights Act 2015.

6. General Terms

6.1 Governing Law These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

6.2 Severability If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining terms, which will continue to be valid and enforceable.

6.3 Amendments Boraca reserves the right to amend these terms and conditions at any time. Any changes will be posted on our website and will take effect immediately upon posting.
